Warranty Policy

This Warranty Policy explains how warranty, statutory conformity and after-sales support apply to products supplied by RF Living OOD under the RF Modular brand.

RF Modular supplies different categories of products, including complete modular units, standard models, configurable units, furniture, accessories, components and products intended for DIY installation.

The applicable warranty therefore depends on the product, how it was supplied, how it was installed and the terms stated in the relevant order or project documentation.

Nothing in this Warranty Policy limits mandatory statutory rights available to consumers under applicable law.

1. Legal Entity

Throughout this policy, “RF Modular”, “RF Living”, “we”, “us” and “our” refer to RF Living OOD.

2. Statutory Rights

Consumers may have statutory rights relating to goods that do not conform to the sales contract.

These rights exist independently of any additional commercial warranty RF Modular may provide.

Nothing in this Warranty Policy should be interpreted as excluding, restricting or replacing rights that cannot legally be excluded.

3. Product Categories

For warranty purposes, RF Modular products generally fall into the following categories.

Complete Modular Units

This includes standard, configurable and bespoke modular structures manufactured and supplied by RF Modular.

Factory-Installed Components and Add-ons

This includes furniture, equipment, electrical products, fixtures, accessories and other components installed by RF Modular as part of a modular unit before delivery.

Separately Purchased Products

This includes accessories, furniture, components, replacement parts and other goods purchased separately through the RF Modular store or by quotation.

DIY Components and Accessories

This includes products supplied for installation by the customer or an independent third party.

Third-Party Equipment

Certain modular units or accessories may incorporate equipment manufactured by third parties.

Examples may include appliances, HVAC equipment, electrical devices, sanitary equipment, electronic products or specialist systems.

4. Applicable Warranty Period

The applicable commercial warranty period, where offered, will be stated in one or more of the following:

  • the product page;

  • order confirmation;

  • quotation;

  • warranty documentation;

  • invoice;

  • technical documentation; or

  • project-specific contract.

Different components of the same modular unit may have different warranty periods.

Where no additional commercial warranty is expressly stated, applicable statutory rights remain in force.

RF Modular does not make any additional warranty-period commitment beyond what has been expressly published or contractually agreed.

5. When Warranty Coverage Begins

Unless otherwise specified in writing, an applicable commercial warranty period generally begins on the date the product is delivered to the customer.

Where RF Modular is responsible for installation or commissioning and the contract expressly provides for acceptance after installation, the applicable project documentation may define a different start date.

6. Complete Modular Units

Where covered by an applicable commercial warranty or statutory conformity obligation, complete modular units may be assessed for defects relating to:

  • manufacturing workmanship;

  • assembly;

  • factory-installed finishes;

  • factory-installed components;

  • agreed specifications; and

  • other elements within RF Modular's contractual scope.

Warranty coverage is limited to defects attributable to the product or work supplied by RF Modular.

7. Factory-Installed Furniture and Accessories

Furniture, accessories and equipment installed by RF Modular during production are treated as part of the supplied modular unit unless otherwise stated.

Where a defect relates to such an item, RF Modular may determine whether the appropriate remedy concerns:

  • the individual component;

  • its installation;

  • the modular unit; or

  • a third-party manufacturer's warranty.

8. Separately Purchased Accessories and Products

Separately purchased products may be covered by:

  • applicable statutory conformity rights;

  • an RF Modular commercial warranty where expressly stated; and/or

  • a manufacturer's commercial warranty.

The warranty applicable to the product will depend on the specific item.

9. DIY Installation

Some RF Modular products are designed to be installed by customers or independent installers.

DIY or third-party installation does not automatically eliminate statutory rights concerning defects that existed when a product was supplied.

However, warranty or conformity claims may not cover damage or failure caused by:

  • incorrect installation;

  • failure to follow installation instructions;

  • unsuitable tools or fixing methods;

  • installation onto an unsuitable structure;

  • incorrect electrical connection;

  • incorrect plumbing;

  • incorrect sealing or waterproofing;

  • unauthorised cutting, welding or drilling;

  • incompatible modifications; or

  • other installation errors.

Where specialist installation is required by applicable regulations or product instructions, customers are responsible for using appropriately qualified personnel.

10. Product Compatibility

Customers purchasing components or accessories for DIY use are responsible for verifying suitability and compatibility before installation.

This is particularly important where the product is intended for a container or modular structure not manufactured by RF Modular.

RF Modular cannot guarantee compatibility with every third-party container, building, system or modification unless compatibility has been expressly confirmed in writing.

11. Third-Party Components

Products manufactured by third parties may be subject to the manufacturer's warranty terms.

Where appropriate, RF Modular may:

  • administer the claim on the customer's behalf;

  • refer the customer to the manufacturer;

  • arrange inspection;

  • arrange repair or replacement; or

  • provide another legally appropriate remedy.

The applicable process may depend on the supplier's warranty conditions and mandatory consumer law.

12. What May Be Covered

Subject to the applicable product terms and legal requirements, a valid claim may concern defects such as:

  • manufacturing defects;

  • defects in materials supplied by RF Modular;

  • assembly defects;

  • incorrect factory installation;

  • products materially differing from agreed specifications; or

  • other non-conformity attributable to RF Modular.

Each claim is assessed individually.

13. What Is Generally Not Covered

To the extent permitted by applicable law, commercial warranty coverage generally does not apply to damage or failure resulting from:

  • ordinary wear and tear;

  • misuse;

  • negligence;

  • accidents;

  • vandalism;

  • unauthorised modifications;

  • incorrect installation;

  • improper maintenance;

  • failure to follow operating or maintenance instructions;

  • unsuitable foundations;

  • movement or settlement of foundations;

  • incorrect utility connections;

  • water ingress caused by third-party works;

  • structural alterations made after delivery;

  • overloading;

  • impact damage;

  • external mechanical damage;

  • inappropriate cleaning products;

  • extreme conditions beyond agreed design parameters;

  • corrosion caused by exposure outside agreed specifications;

  • damage during relocation not arranged by RF Modular;

  • work performed by third parties; or

  • use of incompatible accessories or components.

These exclusions do not apply where doing so would unlawfully restrict mandatory consumer rights.

14. Normal Wear and Consumable Items

Some products naturally deteriorate through normal use.

Depending on the product, consumable or wear items may include:

  • seals;

  • filters;

  • batteries;

  • light sources;

  • moving hardware;

  • surface finishes;

  • soft furnishings; and

  • other components subject to ordinary wear.

Normal deterioration does not necessarily constitute a defect.

15. Surface Appearance and Natural Variations

Materials such as wood, metal, stone, textiles and other finishes may contain natural or manufacturing variations in:

  • colour;

  • grain;

  • texture;

  • pattern; and

  • appearance.

Minor variations that do not affect functionality or agreed quality are not necessarily defects.

Photographs and digital renders displayed online may also differ slightly from the finished physical product because of lighting, screen settings and production batches.

16. Maintenance Obligations

Customers are responsible for reasonable maintenance of products and modular units.

Where maintenance requirements are provided, failure to perform necessary maintenance may affect claims relating to damage caused by that failure.

Maintenance may include, where applicable:

  • inspection of seals;

  • cleaning drainage paths;

  • servicing HVAC systems;

  • maintaining coatings;

  • checking fasteners;

  • protecting exposed surfaces;

  • maintaining utility systems; and

  • following third-party equipment maintenance requirements.

17. Modification of Modular Units

Modular structures may be engineered around specific loads, openings and technical configurations.

Cutting, welding, drilling, removing structural members or making other structural alterations can affect:

  • strength;

  • waterproofing;

  • corrosion resistance;

  • fire performance;

  • electrical safety;

  • regulatory compliance; and

  • warranty coverage.

Customers should seek appropriate technical advice before materially modifying a modular unit.

RF Modular is not responsible for defects caused by unauthorised alterations to the extent permitted by law.

18. Relocation of Modular Units

Some modular units may be capable of relocation.

However, relocation must be carried out using suitable lifting, transport and handling methods.

Damage resulting from incorrect lifting, transportation or repositioning by the customer or a third party may not be covered.

Where RF Modular arranges relocation, the applicable service terms will govern that work.

19. Foundations and Site Conditions

Unless foundations or site works are within RF Modular's contractual scope, the customer is responsible for ensuring that the installation location is appropriate for the modular unit.

Problems caused by:

  • inadequate foundations;

  • differential settlement;

  • poor drainage;

  • unstable ground;

  • flooding;

  • inadequate site preparation; or

  • other site conditions outside RF Modular's scope

may not be covered where they are the cause of the defect or damage.

20. Reporting a Warranty or Defect Claim

Customers should report suspected defects as soon as reasonably possible after discovery.

Please contact RF Modular and provide:

  • your name;

  • order, invoice or project reference;

  • product identification where available;

  • description of the issue;

  • date the issue was first noticed;

  • photographs;

  • videos where useful;

  • installation information where relevant; and

  • any other information reasonably required to investigate the claim.

Customers should avoid further use where continued use could create a safety risk or cause additional damage.

21. Inspection

RF Modular may need to inspect the product before determining the appropriate remedy.

Depending on the product and location, assessment may take place through:

  • photographs;

  • video;

  • remote technical review;

  • return of the product;

  • inspection by an authorised service provider; or

  • an on-site inspection.

Customers should provide reasonable access where an on-site inspection is necessary.

22. Remedies

Where a valid claim is established, the legally or contractually appropriate remedy may include:

  • repair;

  • replacement of a component;

  • replacement of the product;

  • correction of workmanship;

  • price reduction;

  • refund; or

  • another appropriate remedy.

The available remedy depends on:

  • the nature of the defect;

  • the product;

  • applicable law;

  • proportionality;

  • technical feasibility; and

  • the applicable contract.

RF Modular does not automatically provide a full replacement or refund for every warranty claim where another remedy is legally and technically appropriate.

23. Repairs by Third Parties

Customers should not commission third-party repair work and expect reimbursement from RF Modular without prior agreement, except where applicable law gives the customer such a right.

Unauthorised third-party repairs may make it difficult to determine the original cause of a defect.

24. Return of Defective Products

For smaller products, RF Modular may request that an allegedly defective item be returned for inspection.

Where the claim is valid and applicable law requires RF Modular to bear the return cost, appropriate return arrangements will be made.

Large modular products will normally be assessed through project-specific procedures rather than conventional parcel returns.

25. Replacement Products and Components

Where a component is replaced, the replacement may be:

  • identical;

  • an updated equivalent; or

  • a technically comparable alternative

where the original product is no longer available and where permitted by applicable law.

Aesthetic differences may occur between older and newer production batches.

26. Warranty on Repaired or Replacement Items

The warranty treatment of repaired or replacement products will follow applicable law and any specific commercial warranty terms provided for the relevant product.

Nothing in this policy reduces statutory rights.

27. Business Customers

For purchases made in the course of business, applicable warranty obligations may be further defined by:

  • the quotation;

  • project contract;

  • technical specification;

  • acceptance documentation; and

  • other agreed commercial terms.

Where project-specific documentation differs from this general Warranty Policy, the project-specific terms will apply to the extent legally permissible.

28. Safety-Related Issues

If you believe a product presents an immediate safety risk:

  • stop using it where safe to do so;

  • isolate electrical or other utilities where appropriate and safe;

  • prevent further access where necessary; and

  • contact RF Modular promptly.

Do not attempt specialist repairs unless you are qualified to do so.

29. Changes to This Policy

RF Modular may update this Warranty Policy periodically.

The version applicable to an existing commercial warranty will be determined by the terms in force when the warranty was provided unless otherwise required by law.

Updates to this general policy do not retrospectively remove contractual or statutory rights.
